The Family-Based Adjustment of Status Group at Kameli Law oversees permanent residency transitions under INA § 245(a). Adjustment of Status allows foreign nationals physically present in the United States to secure lawful permanent residence without traveling to a foreign embassy, avoiding family separation and the risk of triggering three- or ten-year unlawful presence bars under INA § 212(a)(9)(B).

Work & Travel Permits (EAD / AP)
To adjust status under INA § 245(a), the beneficiary must establish that they were inspected and admitted or paroled into the United States (verified via Form I-94 arrival record). Immediate relatives of U.S. citizens are exempt from the standard bars regarding status expiration or unauthorized employment, provided their initial entry was lawful.

Can I travel outside the United States while my Form I-485 is pending?
Under federal regulation 8 CFR § 245.2(a)(4)(ii), departing the United States while an Adjustment of Status application is pending without first obtaining an approved Advance Parole travel document (Form I-131) results in the automatic abandonment and denial of your Form I-485. The only statutory exception applies to individuals maintaining valid, unexpired H-1B or L-1 nonimmigrant status (and their H-4 or L-2 dependents), who may travel and re-enter using their valid nonimmigrant visas without abandoning their pending adjustment application.
Can an individual who overstayed their visa adjust status through a family member?
Yes, but specifically if the applicant is classified as an Immediate Relative of a U.S. citizen (spouse, unmarried child under 21, or parent of an adult citizen). Under INA § 245(c)(2), the normal statutory bars that prohibit individuals who overstayed their visa or engaged in unauthorized employment from adjusting status do not apply to Immediate Relatives, provided the applicant initially entered the U.S. with inspection and admission (e.g., entered on a valid B-1/B-2, F-1, or work visa). Applicants in Family Preference categories must maintain lawful nonimmigrant status up to the date of filing.
Do I need to submit the Form I-693 medical examination concurrently with Form I-485?
While not statutorily mandatory at the initial moment of filing, USCIS strongly recommends submitting the sealed Form I-693 medical exam concurrently with Form I-485 to avoid administrative Requests for Evidence (RFEs) and unnecessary processing delays. Under updated USCIS policy, properly completed Form I-693 medical exams signed by a designated civil surgeon on or after November 1, 2023, retain indefinite evidentiary validity and do not expire after two years.
What is the "90-Day Rule" regarding adjustment after entering on a tourist visa?
Foreign nationals entering the U.S. on single-intent nonimmigrant visas (such as B-1/B-2 tourist visas or the Visa Waiver Program) represent that they intend to stay temporarily. If an individual marries a U.S. citizen or files for Adjustment of Status within 90 days of entry, USCIS officers may scrutinize whether the applicant engaged in willful misrepresentation of intent at the port of entry. Our firm evaluates timeline evidence and establishes that the decision to marry or adjust arose from bona fide circumstances after lawful entry.
What happens if my Form I-485 is approved while I hold a conditional green card?
If permanent residency is granted through marriage and the marriage is less than two years old on the day of Form I-485 approval, USCIS issues a 2-year Conditional Permanent Resident card. Within the 90-day window immediately preceding the card’s expiration, the couple must file Form I-751 (Petition to Remove Conditions on Residence) to transition to an unconditional 10-year permanent green card.
