What Is the EB-2 National Interest Waiver (NIW)?

The EB-2 NIW is a special category within the Employment-Based Second Preference that allows qualified professionals to self-petition for a green card without a job offer or labor certification if their work substantially benefits the United States.

This pathway recognizes individuals whose expertise, innovation, or service is of such national importance that the government waives the usual employer sponsorship requirements.

Key Advantages of the EB-2 NIW

  • Self-Petition Authority: File on your own—no employer required. Maintain full control over your immigration timeline.
  • Strategic Flexibility: Launch startups, pursue research, or lead public-interest projects while staying on track for your green card.
  • Time & Cost Efficiency: Skip the PERM Labor Certification and often save 12–18 months in processing.
  • Broad Field Applicability: Open to professionals in STEM, healthcare, clean energy, cybersecurity, AI, public health, education, entrepreneurship, and economic development.

Check If You Qualify for NIW

We’ll evaluate your background and provide a personalized NIW eligibility report.

Step 1: Base EB-2 Eligibility

Before qualifying for the NIW, you must first meet EB-2 standards through Advanced Degree or Exceptional Ability.

Advanced Degree

Hold an advanced U.S. degree (master’s or higher) or a foreign equivalent, or a bachelor’s degree plus five years of progressive post-baccalaureate experience directly related to your field.

Exceptional Ability

Show a level of expertise significantly above that normally found in your field. You must meet at least three of the USCIS criteria, such as academic records, professional licenses, publications, awards, professional memberships, or evidence of high remuneration.

Step 2: NIW Standard
(Matter of Dhanasar Three-Prong Test)

USCIS evaluates all NIW petitions under the Dhanasar framework, which assesses:

Substantial Merit and National Importance

  • Demonstrate broad impacts—economic growth, innovation, public health, or national security.
  • Provide objective data: market analysis, policy alignment, or shortage metrics.

Well Positioned to Advance the Endeavor

  • Show a proven record of achievements, funding, and collaborations.
  • Provide strong recommendation letters validating your capacity and results.

Balancing Test

Explain why waiving the job offer requirement benefits the U.S. more than enforcing it—particularly for innovative, entrepreneurial, or high-impact work.

Ideal NIW Candidate Profiles

  • STEM Innovators: AI, biotech, and engineering experts driving U.S. technological leadership.
  • Healthcare Professionals: Physicians and researchers improving access and outcomes in underserved areas.
  • Clean Energy Entrepreneurs: Founders advancing carbon reduction and sustainable technologies.
  • Cybersecurity Specialists: Professionals protecting national infrastructure and data systems.
