Statutory Requirements

Individuals must fulfill three foundational statutory criteria under 8 CFR § 204.5(h) to obtain legal permanent residency under the EB1-A category:

  • Sustained Acclaim: The foreign national must demonstrate sustained national or international acclaim for achievements in the field of endeavor (science, art, education, business, or athletics).
  • Continuous Pursuit: The foreign national must demonstrate an intent to continue working in the same specialized field in the United States.
  • Substantial Benefit: The foreign national must demonstrate that their entry and prospective work will substantially benefit prospectively the United States.
Evidentiary Threshold

EB1-A Documentation Standards

To establish sustained acclaim, the petitioner must either present evidence of a one-time major achievement (a major internationally recognized award such as a Nobel Prize, Pulitzer, Oscar, or Olympic Medal) OR satisfy at least three (3) of the following ten regulatory criteria:

Criterion 1

Nationally or Internationally Recognized Prizes or Awards

Receipt of lesser nationally or internationally recognized prizes or awards for excellence in the field of endeavor.

• Must document award selection criteria, competitors, and regional/national scope (student or institutional awards do not qualify).
Criterion 2

Membership in Prestigious Associations

Membership in associations in the field for which classification is sought that require outstanding achievements of their members.

• Membership conditioned solely on education level, fee payment, or general licensure is legally insufficient.
Criterion 3

Published Material About the Applicant

Published material about the foreign national in professional or major trade publications or other major media.

• The applicant must be the primary subject; citations or brief passing quotes do not meet this standard. Must prove circulation and author details.
Criterion 4

Judge of the Work of Others

Participation, either individually or on a panel, as a judge of the work of others in the same or an allied field.

• Includes peer review for reputable ISI journals, conference editorial committees, grant evaluation panels, or graduate dissertation defense boards.
Criterion 5

Original Contributions of Major Significance

Evidence of original scientific, scholarly, artistic, athletic, or business-related contributions of major significance in the field.

• Proven through commercialized patents, high independent citation impact, transformative business methodologies, or expert testimonials.
Criterion 6

Authorship of Scholarly Articles

Authorship of scholarly articles in the field, in professional or major trade publications or other major media.

• USCIS assesses journal impact factor, ranking in the specialized field, and the scholarly reception of the published research.
Criterion 7

Display of Work at Significant Exhibitions

Evidence of the display of the foreign national's work in the field at artistic exhibitions or showcases.

• Specifically tailored for artists, designers, and visual creators displaying original work in nationally or internationally recognized galleries.
Criterion 8

Leading or Critical Role for Distinguished Organizations

Performance in a leading or critical role for organizations or establishments that have a distinguished reputation.

• Requires documenting the organization's distinguished status alongside tangible proof that the applicant's role directly impacted success.
Criterion 9

High Salary or Significantly Higher Remuneration

Evidence that the foreign national has commanded a high salary or other significantly high remuneration for services.

• Proven by comparing tax returns, compensation contracts, and equity grants with national wage percentiles (e.g., U.S. DOL Bureau of Labor Statistics).
Criterion 10

Commercial Success in the Performing Arts

Evidence of commercial successes in the performing arts, as shown by box office receipts, streaming numbers, or record sales.

• Tailored for musicians, actors, and performance artists demonstrating verifiable commercial distribution and box office traction.
Comparable Evidence Provision (8 CFR § 204.5(h)(4)):

If the 10 regulatory criteria do not readily apply to the applicant's occupation, the petitioner may submit comparable evidence to establish eligibility. This allows innovative professionals, tech founders, and boutique specialists to present equivalent objective indicators of extraordinary ability.

Final Merits Determination (The Kazarian Standard)

Under the landmark precedent Kazarian v. USCIS, establishing three of the ten regulatory criteria is merely Step One of the adjudication. Once the numeric threshold is met, the adjudicating officer proceeds to Step Two: The Final Merits Determination.

In this final phase, USCIS evaluates the totality of evidence to determine whether the applicant has sustained national or international acclaim and is truly one of that small percentage of individuals who have risen to the very top of their field of endeavor.

Legal Strategy Note: Winning an EB1-A petition requires more than just counting credentials. Our legal team crafts comprehensive legal briefs that weave your narrative across every piece of evidence, preemptively defeating subjective challenges during the Final Merits Determination.
